Last updated: 17 September 20268.1 Statutory 14-day withdrawal returns
For Germany-market consumer distance purchases where the statutory German/EU right of withdrawal applies, the customer has 14 days to notify the seller of the decision to withdraw. For goods, the period generally begins when the customer or a designated third party other than the carrier receives the goods, subject to the statutory rules for separate or partial deliveries. After giving notice of withdrawal, the goods must be sent back without undue delay and no later than 14 days after the withdrawal notice. Unless a longer voluntary return period is expressly promised for a specific order, HABÄNE does not grant an additional commercial return period beyond statutory rights. India-market purchases are governed by applicable Indian consumer law and the India-market return/refund information shown before purchase; this section does not create a German statutory withdrawal right for India-market transactions.
8.2 Condition of returned goods and diminished value
A consumer may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning, comparable to an inspection in a retail store. The consumer may be responsible for diminished value caused by handling beyond what is necessary for that inspection, provided the statutory information requirements have been satisfied. Statutory rights for defective, damaged, incorrect or otherwise non-conforming goods remain unaffected.
8.3 Return shipping costs
For a Germany-market statutory withdrawal, the consumer bears the direct cost of returning the goods only where the consumer was properly informed of that obligation before the contract was concluded and the seller has not agreed to bear the cost. This does not affect statutory rights where the goods are defective, incorrect or otherwise non-conforming. If a product cannot normally be returned by post, the legally required amount or reasonable estimate of the direct return cost must be disclosed before the order is placed.
8.4 Refunds after withdrawal
Following a valid statutory withdrawal, the seller reimburses payments received from the consumer, including the cost of the least expensive standard delivery offered, without undue delay and no later than 14 days after receiving the withdrawal notice. Additional delivery costs resulting from the customer choosing a more expensive delivery method than the least expensive standard option are not reimbursed. For sales of goods, reimbursement may be withheld until the goods are received back or the consumer provides evidence of return, whichever occurs first, unless the seller has offered to collect the goods. The same payment method is used unless another method is expressly agreed and causes no cost to the consumer.
8.5 Defective, damaged or incorrect goods

Mandatory statutory remedies remain unaffected and are separate from any withdrawal or cancellation right. Depending on the applicable law, remedies may include repair or replacement, price reduction, termination/refund and damages.
8.6 Statutory exceptions and no additional voluntary return period
The statutory right of withdrawal does not apply in the cases set out by law, including certain goods made to the consumer’s specifications or clearly personalized goods, and other statutory exceptions where their conditions are met. Any relevant exception must be disclosed before purchase. Unless HABÄNE expressly promises a longer voluntary return period for a specific order, only the applicable statutory withdrawal, conformity, warranty and defect rights apply.
